Artisan Portrait Terms & Conditions for Legacy Projects

Session Booking:

To reserve your session time, a fully refundable deposit is required. Amount depends on day of the week and session type.

This applies to all portrait sessions.

Your holding deposit will be refunded in full unless you:

  • Reschedule your session more than twice.
  • Do not show up for your scheduled session.
  • Cancel or reschedule within 72 hours or your session day and time.
  • Fail to select your gift portrait or place your portrait order within 30 days of your session.

All reasonable efforts will be made to contact the client to reschedule, schedule an order appointment as needed, and accommodate exceptional circumstances.

What does a complimentary portrait experience include?

It includes a complimentary photoshoot in studio with one of our experienced photographers.

The photoshoot is valued at $350.

It includes an ordering session for you to see an edit of the images taken by the photographer.

You can choose one image to be produced into an 8×10″ or 11×14″ fully-finished print depending on project type. The value ranges from $300-$700.

Any additional images need to be purchased at the designated retail price.

We have multiple artwork sizes and collections that can be customized to suit your home.

If you choose to purchase additional images instead of the single complimentary print, the value from the complimentary print can be used as credit toward any of the purchased up-sizing or collections.

Each experience is valid for a session for a limited number of participants.

Additional participants may be subject to a fee.

This experience cannot be used with any other offer, redeemed for cash, or used in any other way than described in your project experience.

This experience cannot be used to purchase images from a previous portrait session.

Our experiences are valid for complete family groups only. Unfortunately, we cannot accept partial families to avoid potential disappointment.

Only one Project experience may be redeemed per family per year.

Sessions and/or gifts are non-transferable and can only be used by the person it is registered to. It cannot be sold or given to another family member, friend, or individual.

Sales Terms and Conditions:

If you place an order with Artisan Portrait it will have the following terms and conditions.

We retain the copyright to all imagery and reserve the right to use it for displays, exhibitions, or promotional/marketing purposes.

All imagery will go through retouching, smoothing skin, and removing of non-permanent marks.

Any other requests must be made at the time of your order and specified on the order form.

Your order will be ready 6 weeks from the day your order is placed.

Warranty Policy:

If your order arrives to you damaged and cannot be used for its intended use, we will replace the item free of charge.

If your framed products are damaged or lost in a disaster such as fire, flood, earthquake, explosion, or moving homes, we will replace your framed products for any of these reasons for a 100-year period from your purchase date.

The production period for these replacements is 6 weeks.

Refund Policy:

Artisan Portrait creates a custom bespoke order especially for you.

Due to the nature of our artwork, we have adopted a no refund policy.

However, we do offer a 48 hour amendment period. Within 48 hours of your order, you can contact us in writing to amend your order.

Your order cannot be changed or amended after this 48 hour period.

Payment Plan Options:

Artisan Portrait offers personalized, flexible payment options to help you pay off the cost of your order over a period of time.

Artisan Portrait Internal Payment Plans

Artisan portrait offers in house payment plans up to 12 months.

With a choice of either weekly, bi-weekly, or monthly payment installments.

All installments are interest-free.

The payment plan will be authorized by you via signature on the sale invoice.

The authorized installments must be direct debited from a nominated credit card as outlined on the sale invoice until the balance of the invoice is paid off.

All installments outlined in your payment plan will be debited as per the payment schedule starting on the nominated date on the sales invoice.

Any physical products ordered will be available for pick up or shipping once you reach 60% of your invoice total.

Any electronic files ordered will be sent to you via email link upon completion of your payment plan.

If you wish to make additional payment or pay out of your payment plan, you can do this at any point.

Defaulting on the Payment Plan:

If your scheduled payment is declined, Artisan Portrait will attempt to re-process that scheduled payment on the next business day.

Should this 2nd payment decline 14 days from this date, Artisan Portrait will issue you a notice to rectify the payment within 14 days.

If your account is not updated within 30 days from the original notice to rectify, we reserve the right to allocate your overdue payments to a debt collection process. Any fees associated with this will be at your cost.

In the event of any change to your credit card number or credit card expiry for either the principal or supplementary credit card(s) used for your recurring payment plan, you must notify the studio accordingly.

Gift Vouchers:

All gift vouchers are valid for a period of 3 years after the date of purchase unless otherwise stated.

Privacy Policy:

At Artisan Portrait, we take your privacy seriously and are committed to protecting it. Our collection, storage, use, disclosure, and handling of your personal information is kept in house and never disclosed to a third-party.

What personal information does Artisan Portrait collect and why?

Personal information refers to information or an opinion about an identified or reasonably identifiable individual. During the provision of our services and products, we may collect personal information such as:

  • Contact and identification information such as your name, address, telephone/mobile numbers, and email address;
  • Credit card and other banking information for payment facilitation of our services and/or products;
  • Images of you included in photographic materials; and
  • Other information such as your hobbies or interests for personalization of your photography session.

In some cases, we may also hold additional personal information provided by you. We assure you that your personal information will be collected and handled with care and concern.

How does Artisan Portrait collect personal information?

Generally, Artisan Portrait collects your personal information directly from you through:

  • The completion of a manual or online form, such as an application form on Artisan Portrait’s website or a promotional form on social media platforms;
  • An interaction or exchange in person, such as through a face-to-face meeting, or by way of telephone, email, post, SMS text, or through the use of Artisan Portrait’s website;
  • When you enter a Artisan Portrait auction/promotion through affiliates, online offers, or events; and/or
  • Third parties with which Artisan Portrait has a partnership.

Why does Artisan Portrait need your personal information?

Artisan Portrait collects, holds, uses, and discloses your personal information where it is reasonably necessary for the purposes of:

  • Providing to you personalized photography services and photography products, including processing your orders or application and dealing with requests, enquiries, or complaints and other customer care-related activities;
  • Issuing to you your Artisan Portrait experience;
  • Accounting, billing, and other internal administrative and business management purposes; and carrying out market and product analysis.

Artisan Portrait may also use your personal information, including your image, quotes, or other information for inclusion with our marketing materials, where you have consented to such use.

Artisan Portrait may use your personal information for purposes related to the above purposes and for which you would reasonably expect Artisan Portrait to do so in the circumstances, or where you have consented or the use is otherwise in accordance with law. Where personal information is used or disclosed, Artisan Portrait takes steps reasonable in the circumstances to ensure it is relevant to the purpose for which it is to be used or disclosed.

You are under no obligation to provide your personal information to Artisan Portrait. However, without certain information from you, Artisan Portrait may not be able to provide its services and/or products to you.

Direct Marketing:

Artisan Portrait may use and disclose your personal information in order to inform you of services and/or products that may be of interest to you from Artisan Portrait. In the event you do not wish to receive such communications, you can e-mail us at hello@artisanportrait.com to opt-out. Please ensure you opt-out with the email you have been registered with.

To whom does Artisan Portrait disclose your personal information?

Artisan Portrait discloses your personal information for the purpose for which Artisan Portrait collects it, as set out above. This may include disclosing your personal information to:

  • Third parties engaged to perform administrative or other services on behalf of Artisan Portrait;
  • Third parties for the provision of financial services, if and to the extent that customers choose to use such services;
  • People or entities considering acquiring an interest in Artisan Portrait enterprise or assets or otherwise working with Artisan Portrait to facilitate the provision of its services and/or products;
  • Artisan Portrait professional advisors, contractors, consultants, and related bodies corporate.

Disclosures to third parties are on a confidential basis or otherwise in accordance with law. Artisan Portrait may also disclose your personal information with your consent or if disclosure is required or authorized by law. Security of your personal information – Artisan Portrait takes steps reasonable in the circumstances to ensure that the personal information it holds is protected from misuse, interference, and loss and from unauthorized access, modification or disclosure. Artisan Portrait holds personal information in both hard copy and electronic forms in secure databases on secure premises, accessible only by authorized staff. Artisan Portrait will destroy or de-identify personal information in circumstances where it is no longer required unless Artisan Portrait is otherwise required or authorized by law to retain the information.

How to Access and Correct Your Personal Information:

Artisan Portrait takes steps reasonable in the circumstances to ensure personal information it holds is accurate, up-to-date, complete, relevant and not misleading. Under the Privacy Act, you have a right to access and seek correction of your personal information that is collected and held by Artisan Portrait.

If at any time you would like to access or correct the personal information that Artisan Portrait holds about you, or you would like more information on Artisan Portrait’s approach to privacy, please contact Artisan Portrait through email at hello@artisanportrait.com.

Artisan Portrait will grant access to your personal information to the extent required or authorized by the Privacy Act or other law and take steps reasonable in the circumstances to correct personal information where necessary and appropriate.

To Obtain Access to Your Personal Information:

You will have to provide proof of identity to ensure that personal information is provided only to the correct individuals and that the privacy of others is protected.

Artisan Portrait requests that you be reasonably specific about the information you require.

Privacy Complaints:

Please direct all privacy complaints to Artisan Portrait’s owner and operator via email at hello@artisanportrait.com.

At all times, privacy complaints:

  • Will be treated seriously;
  • Will be dealt with promptly;
  • Will be dealt with in a confidential manner; and
  • Will not affect your existing obligations or affect the commercial arrangements between you and Artisan Portrait.
What are your mobile terms?

When you provide us with your mobile phone number, you agree that our organization may send you text messages (including SMS and MMS) to that phone number. You will receive a confirmation text message, and you may need to reply as instructed to complete registration. We may send you up to 40 messages per month. Message and data rates apply. Reply STOP to cancel, HELP for help. You agree to receive a final text message confirming your opt-out. You may opt-out at any time by texting the word STOP to the number 208-773-9712. For help, send a text message with the keyword HELP to the number 208-773-9712. Texts may be sent through an automatic telephone dialing system. Consent is not required to purchase our goods or services. You agree to notify us of any changes to your mobile number and update your account us to reflect this change. Your carrier may prohibit or restrict certain mobile features and certain mobile features may be incompatible with your carrier or mobile device. Contact your carrier with questions regarding these issues.

How do I opt out of these text messages?

You can cancel the SMS service at any time. Just text STOP to 208-773-9712. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
